Terms of Service

1. Acceptance of Terms

By accessing or using PeekCast ("the Service") you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately stop using the Service. Your continued use of the Service after any modification to these Terms constitutes acceptance of those modifications.

2. Description of Service

PeekCast is operated by Starry Mountain LLC, a Washington limited liability company ("Starry Mountain," "we," "us," or "our"). PeekCast is a discovery tool that aggregates publicly available Twitch streaming data to help users find live streams and videos related to specific events and communities. PeekCast is not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc. Twitch content is provided by the Twitch API and is subject to  Twitch's Terms of Service.

3. Eligibility

You must be at least 13 years of age to use the Service. By registering you represent and warrant that (a) you meet this age requirement; (b) you have the legal capacity to enter into a binding agreement; and (c) the information you provide is accurate, current, and complete. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Accounts

  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You are solely responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without liability to you.

5. User-Generated Content

Registered users may create "event" configurations that aggregate Twitch streams around a topic or community. By creating an event you represent and warrant that:

  • You have the right to create and publish the event configuration.
  • The event does not infringe any third-party intellectual property rights.
  • The event complies with Twitch's Terms of Service and Community Guidelines.
  • The event does not contain, promote, or facilitate any illegal activity or content.

We reserve the right to remove any event configuration at our sole discretion, without notice and without liability to you.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to any part of the Service or its underlying systems.
  • Scrape, crawl, or systematically extract data from the Service without our prior written consent.
  • Use the Service to harass, defame, threaten, or harm other users or streamers.
  • Circumvent any technical measures we use to provide the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Introduce malicious code, viruses, or any other harmful material into the Service.

7. Twitch Content and Attribution

Stream titles, thumbnails, viewer counts, and other data displayed on PeekCast are sourced from the Twitch API and remain the property of Twitch Interactive, Inc. and the respective content creators. PeekCast displays this data for discovery purposes only and does not host, store, or re-broadcast any stream video. Use of Twitch data is governed by the  Twitch Developer Agreement.

8. Intellectual Property

The PeekCast name, logo, and original code are the property of Starry Mountain LLC. Twitch, the Twitch logo, and all related marks are trademarks of Twitch Interactive, Inc. Nothing in these Terms grants you a license to use those marks.

9. Copyright and DMCA

PeekCast does not host user-uploaded or user-created media content. If you believe that material accessible through the Service infringes your copyright, please contact us at  contact@peekcast.com with: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement of good faith belief; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY TWITCH DATA OR OTHER THIRD-PARTY CONTENT DISPLAYED THROUGH THE SERVICE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • STARRY MOUNTAIN LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • IN NO EVENT SHALL STARRY MOUNTAIN LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US $100).
  • SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Starry Mountain LLC and its members, managers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) any content you submit to or publish through the Service. This indemnification obligation survives termination of these Terms and your use of the Service.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if the claim qualifies. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. To initiate arbitration, contact the AAA at www.adr.org or 1-800-778-7879. Arbitration shall be conducted in King County, Washington, or by videoconference at the election of the consumer.

Starry Mountain LLC will pay all AAA filing, administration, and arbitrator fees for any arbitration it initiates. For arbitration you initiate, AAA Consumer Arbitration Rules govern fee allocation. Neither party shall be required to pay more than $250 in fees for any consumer arbitration claim of $10,000 or less.

CLASS ACTION WAIVER: YOU AND STARRY MOUNTAIN LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If a court decides that applicable law precludes enforcement of this waiver as to any claim, then that claim must be severed from the arbitration and may be brought in court, while all other claims subject to arbitration remain in arbitration.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to contact@peekcast.com with the subject "Arbitration Opt-Out." Opting out does not affect any other provision of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, without liability to you. You may discontinue use at any time. Sections 8, 9, 10, 11, 12, 13, 15, and 16 survive any termination of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles. To the extent that any Dispute is not subject to arbitration under Section 13, you and Starry Mountain LLC agree to submit to the exclusive personal jurisdiction of the state and federal courts located in King County, Washington for the resolution of any such Dispute.

16. General Provisions

  • Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
  • Force Majeure. We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, government action, or internet infrastructure failures.
  • No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
  • Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Starry Mountain LLC regarding the Service and supersede all prior agreements, representations, and understandings.
  • Assignment. You may not assign these Terms or any rights hereunder without our prior written consent. Starry Mountain LLC may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. If we make material changes, we will make reasonable efforts to notify registered users. Continued use of the Service after changes constitutes acceptance of the updated Terms.
